Terms of Sales

The General Conditions of Sale define the conditions applicable to sales concluded between on the one hand the persons making a purchase via the Internet site of XTREM-ELECTRA www.xtrem-electra.com, hereinafter called “the Customer” and other share the company XTREM-ELECTRA, here in after called “xtrem-electra.com”. These conditions exclusively concern only non-commercial individuals.

Price of items:
All prices are indicated in euros all taxes included, excluding participation in shipping costs (see Shipping and Delivery paragraph).
The period of validity of the prices of items offered on xtrem-electra.com is 24 hours from their publication on the site www.xtrem-electra.com. Items will be billed based on the rates in effect at the time of order entry. They remain the property of xtrem-electra.com until full payment is received by xtrem-electra.com. This price is payable in full and in a single payment.

Ordered :
The customer can place an order on the website www. xtrem-electra.com.
The order process is as follows:
– Choice of articles and addition to the basket
– Validation of the contents of the basket
– Identification on the site www.xtrem-electra.com if the customer is not already identified
– Choice of delivery method
– Choice of payment method and acceptance of the GTC
– Payment validation.
The customer will receive an order confirmation email.
The customer can view during these different stages the details of his order and its total price and correct any errors, before confirming it to express his acceptance.
xtrem-electra reserves the ownership of the articles until full payment of the order, that is to say the collection of the price of the order by xtrem-electra.
xtrem-electra reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who presents to him any form of risk.
Any order implies acceptance of the prices and description of the items available for sale.
xtrem-electra undertakes to honor orders received on the website only within the limits of available stocks. In the absence of availability of one or more item (s) ordered, xtrem-electra.com undertakes to inform the client thereof as soon as possible, and if necessary to reimburse it no later than 30 days after the payment of the sums paid. The customer’s order will then be automatically canceled.

Shipping and Delivery:
Any order placed on the site xtrem-electra.com will be sent after manufacture of the article in our factory abroad.
Indeed, each product is manufactured following the customer’s order.
The delivery costs may vary depending on the weight of the products.
The customer has a period of 15 working days from the date of shipment of the order to request the resolution of the sale and the refund of the items on the grounds that it would not have been delivered.
No delivery dispute will be accepted after this period.
The customer is required to check the condition of the items delivered.
Any anomaly concerning the articles (damage, missing article compared to the order form, damaged or opened package, broken, defective article…) must be imperatively indicated within 3 days of delivery.
Any open, incomplete package and / or any damaged item must not be accepted by the Customer. The Customer will inform xtrem-electra.com of the problem encountered the same day.
All items offered by xtrem-electra.com are subject to the legal warranty provided for in articles 1641 and following of the Civil Code. (See paragraph Guarantee)
Delivery in mainland France, Principality of Monaco and Andorra.

Payment :
Metropolitan France, Principality of Monaco and Andorra
Payment for purchases is made at the customer’s choice:
– by bank card: Visa, MasterCard, Carte Bleue, issued in France
– by bank check
– by PayPal

In the event of payment by check, this must be issued by a bank domiciled in mainland France and made payable to xtrem-electra. It is to be sent to xtrem-electra, 10 rue des fours 31700 CORNEBARRIEU.
The items ordered are then reserved 5 days from the date of order. After this period and failing receipt of the corresponding check, xtrem-electra.com reserves the right to cancel the customer’s order. The check will then be returned to him upon receipt.
The collection is made upon receipt of the check.

Payment validation :
Payment is validated upon receipt of the check in the event of payment by check and on receipt of the additional information requested in the event of payment by credit card requiring additional verifications (See paragraph Fight against fraud with the credit card).
Registration of bank details :
xtrem-electra.com offers the Customer the possibility of registering their bank details to settle future purchases more easily and more quickly on the Site.
To do this, the Customer must:
– pay your last purchase in euros and by credit card on the Site
– tick the box “save my information for my next payments” on the credit card payment page
– enter your contact details (the bank details entered on the payment page are encrypted and secure)
– validate the payment. Once the payment has been validated, the data relating to the delivery (address and method of delivery), billing and the bank card used are saved. The Customer’s bank details are not kept by xtrem-electra.com but by our payment provider on secure servers.
The Customer can subscribe to the registration of his bank details and thus choose to pay for his future purchases with a click by bank card and in euros only on the Site without having to enter his bank details again.
However, the cryptogram may be requested from the Customer for security reasons.
He can at any time delete the data relating to the registered bank card and / or add another bank card by clicking on the link provided for this purpose accessible on the Site in the “My means of payment” section in ” My account “. The Customer is then redirected to a secure page and can thus view the bank card (s) registered on the servers of our payment provider.
xtrem-electra.com reserves the right to verify the personal data communicated by the Customer and to adopt all the measures deemed necessary for the verification of the fact that the person whose bank account is debited is indeed the one who placed the order, this in order to avoid any fraudulent payment (See Fight against credit card fraud).

Fight against credit card fraud:
The information related to your order is subject to automated data processing. The purpose of this automated data processing is to define a level of analysis of a transaction and to fight against credit card fraud.

Visibilities and xtrem-electra.com are the recipients of the data related to your order. The non-transmission of data related to your order prevents the completion and analysis of your transaction.
The occurrence of an unpaid account on the grounds of fraudulent use of a bank card will result in the registration of contact details relating to your order associated with this unpaid item in a payment incident file implemented by Visibilities. An irregular declaration or an anomaly may also be subject to specific treatment.
In accordance with the Data Protection Act of January 6, 1978 you have, at any time, a right of access, rectification, and opposition to all of your personal data by writing, by mail and justifying your identity, at Visibilities.
xtrem-electra.com reserves the right to verify the personal data communicated by the customer and to adopt all the measures deemed necessary for the verification of the fact that the person whose bank account is debited is indeed the one who placed the order, this in order to avoid any fraudulent payment.
This verification may take the form of a request for proof of identity and / or domicile and / or bank documents (RIB or canceled check). The lack of response from the customer to a request of this type within 2 days of the request made by xtrem-electra.com will automatically result in the cancellation of the order concerned, without any possibility of subsequent complaint.
xtrem-electra.com will also be free to proceed with the direct cancellation of an order which would present one or more risk factors for fraudulent use of bank card.

Exchange, return and refund.

Deadline to return an item:
The customer has a legal period of 14 clear days to exercise his right of withdrawal from the date of receipt of the goods without having to justify reasons or pay penalties. The procedures for exercising this right of withdrawal are mentioned in the “Exchange and return conditions” paragraph below. Return costs are payable by the customer. The customer will be fully reimbursed for the amounts paid (except shipping costs) upon receipt and verification of the return of his articles without undue delay and at the latest within 14 days of the date on which he exercised his right of withdrawal.
xtrem-electra.com will reimburse the Customer using the same means of reimbursement as that used for the initial transaction.

In order for the withdrawal period to be respected, the Customer must send us his communication relating to the exercise of his right before the expiration of the withdrawal period.
xtrem-electra extends the customer’s right of withdrawal to 100 days, subject to compliance with the conditions set out in the paragraphs below.

Exchange and return conditions for refund
The returned item (s) must be new, unused and in their original box perfectly intact.
Any exchange or return must be the subject of an exchange or return request from the “My Account” section of the xtrem-electra.com site.

The customer can make a single return or exchange request online per order on the xtrem-electra.com site.

If the customer’s order contains several articles and he wishes to return more than one article, he must select during this return request all the articles which he wishes to exchange or be reimbursed.
Return costs are the responsibility of the customer.

Shipping of exchange order:
If he has chosen to send us his return parcel in Colissimo, his exchange order will be dispatched within 48 hours of the reinstatement of the returned items in stock.
If the amount of the customer’s exchange order is greater than the amount of his initial order, he may pay the difference online by bank card or check to the following address: XTREM-ELECTRA, Customer Service, 10 rue des fours 31700 Cornebarrieu . The shipment of the customer’s exchange order is subject to the validation of these regulations.

If the amount of the customer’s exchange order is less than the amount of the initial order, xtrem-electra.com will reimburse the difference: within 5 days of receipt of his package returned to our warehouse if he has returned his package to us via Colissimo.

The customer must keep the proof of deposit of the package which will be given to him by La Poste. In case of loss of the package, no unlocking of order, exchange or refund can be made without this proof of deposit.

The customer has a period of 30 working days from the date of deposit of his return package to make any claim relating to his return.
No request will be accepted at the end of this period.
The customer must send their complaint by e-mail via the contact form on the Customer Service page of xtrem-electra.com or by post to be sent to the following address: XTREM-ELECTRA, Customer Service, 10 rue des fours 31700 Cornebarrieu.

Condition of items:
All returned items (items, original packaging, accessories, instructions, etc.) must be returned intact.
Upon receipt of the package, xtrem-electra.com will judge the perfect condition of the returned goods. No returns will be accepted if the returned items have been visibly used or damaged by the customer and this use or such damage makes the items unfit for sale. If the return is refused by xtrem-electra.com, the articles will then be returned to the customer at the expense of xtrem-electra.com without the customer being able to demand any compensation or right to reimbursement, with the exception of the subsequent financial year. of its warranty rights on the goods sold.
In the case of an exchange, if the items returned have been visibly used or damaged by the customer and this use or such damage makes them unsuitable for sale, xtrem-electra.com may exercise all corresponding recovery actions with the customer.

Refund of returns:
Subject to compliance with these return conditions, xtrem-electra.com will reimburse items returned within 7 days of reinstating the goods in stock.

Securing transactions :
xtrem-electra.com implements all means to ensure the confidentiality and security of the data transmitted on the web and on the website http: // www. xtrem-electra.com. As such, the website uses a secure payment module such as SSL (Secure Socket Layer).

The photographs and illustrations accompanying the products on our website have no contractual value and therefore cannot engage the responsibility of xtrem-electra.com.

Guarantee:
All items offered by xtrem-electra.com are subject to the legal warranty provided for by articles L211-1 and following of the Consumer Code and to the warranty for hidden defects provided for in articles 1641 and following of the Civil Code.
The customer has a period of 3 days from receipt of the product to form any reservations or complaints for apparent non-compliance or apparent defect of the items delivered, by e-mail via the contact form; or by registered mail with acknowledgment of receipt to the following address: XTREM-ELECTRA,

After this period and failing to comply with this formality, the articles will be deemed to be in conformity and free from any apparent defect and no claim may be validly accepted by xtrem-electra.com.
If the apparent defect or lack of conformity of the article is proven, xtrem-electra.com undertakes to replace the article or reimburse the customer as soon as possible and at his expense.
This reimbursement will take place within a maximum of 14 days.
xtrem-electra.com cannot be held responsible for the improper use and / or the intensive use of the articles that the customer could make of it.

Intellectual property :
All texts, comments, works, illustrations and images reproduced on xtrem-electra.com are reserved under copyright as well as intellectual property and for the whole world.
As such and in accordance with the provisions of the intellectual property code, only use for private use is authorized, subject to different, even more restrictive, provisions of the intellectual property code. Any total or partial reproduction of the xtrem-electra.com site is strictly prohibited without prior agreement.

Applicable right :
These general conditions of use and sale are subject to French law. In the event of persistent disagreement on the application, interpretation and execution of these terms, and in the absence of an amicable agreement, any dispute will be brought before the competent French courts.
